General Information:

The Republic of Malta is an archipelago consisting of three inhabited islands Malta, Gozo and Comino. The Maltese islands are situated in the middle of the Mediterranean Sea about 100 km South of Italy.

Malta is a Civil Law jurisdiction, however, all modern legislation including company, tax and maritime laws are modelled on their UK counterparts.

Regulatory Body

Malta Lotteries and Gaming Authority (LGA)

Type of Licenses:

Class 1 – Online Gaming (Operators who partake in unlimited risk on games depending on repetitive occurrences)

Class 2 – Online betting office or online betting exchange (Operators who manage their risk on a singular event, e.g. Fixed Odds betting, pool betting and spread betting)

Class 3 – Online promotion of gaming from Malta (operators who receive a commission);

Class 4 – Hosting and managing online gaming operators, excluding the licensee himself (Platform operators or software vendors)

Gaming Tax:

Casino-type Games - LM 2000/month (first 6 months); Lm3,000/month (entire duration of the license period).

Class 4 Remote Gaming platform:

Operator: no tax for the first six months after the issue of the license; Lm1,000/month for the subsequent six months; Lm2,000/per month for the entire duration of the license.

Licensee (operating from the hosting platform) - Lm500/month.

Online Betting Operations - 0.5% on gross amounts of bets.

Online Betting Exchanges - 0.5% on the sum of all net winnings calculated per player per betting market.

Pool betting – 0.5% on the aggregate of stakes paid.

In all cases the total maximum of tax payable per annum by one licensee in respect of any one license shall not exceed Lm200,000.

In the case of licensees operating on a platform licensed under license 4, the tax cap applies to the tax payable by all licensees operating on the platform.

Government Aapplication & License Fees:

Application fee - Lm1,000 - payable together with the submission of an application for the licence;

License Fee - LM 3000 (for a 5 year license)

Renewal Fee - Lm500

Type of Company:

LTD (Limited Company)

Company Taxation:

ITC and IHC companies are taxed at the normal rate of 35% but if shareholders are non-resident a tax refund is given upon receipt of dividends, which means the effective tax rate is 4.17% in the case of an ITC and 0% in the case of an IHC.
